1. About Donations.com
Donations.com is a technology platform, not a charity, nonprofit, or financial institution. We provide software tools that allow individuals and organizations to create donation pages and receive cryptocurrency and fiat payments. We do not solicit, collect, manage, or distribute donations on behalf of any user.
We are a neutral technology provider. We do not endorse, verify, or guarantee any cause, campaign, user, or organization listed on our platform. We have no obligation to vet the legitimacy of any fundraising activity conducted through our service.
2. Acceptance of Terms
By accessing or using Donations.com ("the Platform," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
3. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Platform. By creating an account, you represent that you are legally able to enter into binding agreements and that your use of the Platform complies with all applicable laws.
4. Non-Custodial Service
Donations.com operates as a non-custodial platform. All cryptocurrency transactions occur directly between the donor and the recipient's wallet address. We never hold, control, or have access to any user funds. Users are solely responsible for the security of their wallet addresses, private keys, and seed phrases.
We are not responsible for any loss of funds due to incorrect wallet addresses, blockchain network issues, smart contract failures, wallet compromises, or any other circumstances beyond our control.
5. User Responsibilities
As a user of the Platform, you agree that:
- All information you provide (including wallet addresses, descriptions, and profile details) is accurate and not misleading.
- You are solely responsible for the legality, legitimacy, and nature of any cause or campaign you create.
- You will comply with all applicable local, state, national, and international laws and regulations, including but not limited to tax reporting obligations, anti-money laundering (AML) laws, and charitable solicitation regulations.
- You will not use the Platform for any illegal, fraudulent, or deceptive purpose.
- You will not impersonate any person or entity, or misrepresent your affiliation with any person or entity.
6. Donor Responsibilities
If you make a donation through the Platform, you acknowledge that:
- Your donation is made directly to the recipient's wallet address. Donations.com does not process, hold, or intermediate the transaction.
- You are responsible for conducting your own due diligence on any cause or campaign before donating.
- Cryptocurrency transactions are generally irreversible. We cannot reverse, refund, or recover any donation.
- Donations.com makes no representations about the tax-deductibility of any donations made through the Platform.
7. Prohibited Uses
You may not use the Platform to:
- Engage in or facilitate money laundering, terrorist financing, or sanctions evasion.
- Solicit funds under false pretenses or through fraudulent campaigns.
- Violate the intellectual property rights of others.
- Distribute malware, viruses, or other harmful code.
- Engage in any activity that could damage, disable, or impair the Platform.
- Create campaigns that promote violence, discrimination, or illegal activity.
We reserve the right to remove any content and suspend or terminate any account that we believe, in our sole discretion, violates these Terms or applicable law.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DONATIONS.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any losses, damages, or claims arising from the use or inability to use the Platform.
- The conduct, actions, or omissions of any user, campaign creator, or donor.
- The legitimacy, accuracy, or legality of any campaign, cause, or fundraising activity on the Platform.
- The loss, theft, or compromise of cryptocurrency or other digital assets.
- Any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Indemnification
You agree to indemnify, defend, and hold harmless Donations.com and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law or regulation.
10. Intellectual Property
The Donations.com name, logo, and all related branding are the property of Donations.com. Users retain ownership of their own content but grant us a limited, non-exclusive license to display their profile information, descriptions, and images on the Platform as necessary to provide our services.
11. Privacy
We collect minimal personal information necessary to operate the Platform, primarily through X (Twitter) OAuth authentication. We do not sell your personal information to third parties. 12. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Any funds already sent to your wallet addresses remain yours, as we are non-custodial.
13. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
